That experience permits the firm to immediately identify and assess the array of concerns and competing obligations that arise in disputes involving investment funds and similar entities. Our matters have involved an extremely wide array of fund litigation, including investor and counterparty disputes, partnership disputes, employment-related disputes, and regulatory defense matters.

  • Most recently, Sean O'Brien and Sara Welch  represented a hedge fund manager as co-lead counsel in jury trial pursuing claims of fraud and breach of fiduciary duty against a well-known public REIT, obtaining a verdict of $12.7 million, including punitive damages, and dismissal of all claims asserted against the client.
  • Sean O'Brien and Sara Welch represented a multibillion-dollar hedge fund in a three-week jury trial, obtaining dismissal of all damage claims brought against the fund, and $3 million in damages and attorneys' fees award in favor of the fund.
  • Sean O'Brien represented a hedge fund that was the subject of an insider trading investigation and related lawsuit brought by SEC, obtaining a dismissal of all claims.
  • Sara Welch represented a private equity fund and its principal in onshore and offshore litigation involving challenge to a restructuring of the fund. Through her efforts, she obtained a ruling upholding restructuring and dismissal of all claims.
  • Mr. O'Brien represented a private equity firm in an array of litigation in both state and federal courts arising out of investment in an e-commerce venture. Mr. O'Brien also represented a portfolio company of a private equity firm and obtained dismissal of all claims upon summary judgment.
